What is National Filing?

National patent filing refers to the process of registering your invention directly at a specific country’s patent office. In general, it is divided into two main categories:

  1. Provisional Filing (Temporary)
A short-term filing that secures your priority date.
We usually recommend handling provisional filings through the PCT system, as it provides international recognition and a smoother transition to national phases.
  2. Permanent Filing (20-Year Protection)
This is the full national filing that can grant you a 20-year patent certificate in the chosen country. It includes preparing all required documents, verifying inventor identity, submitting the application, monitoring search results, responding to examiner comments, and even filing appeals if necessary—until the final patent certificate is issued.

FAQ – National Patent Filing

1. Is the entire process online?

Yes. From registration to filing and follow-up, everything is handled online. You can track the status of your order through your personal dashboard.

2. Can I communicate with the expert handling my order?

Yes. You can request direct communication with the expert via WhatsApp or email through your dashboard.

3. Is my existing description valid for all countries?

Yes, if you already have an international (PCT) filing, the description is generally recognized internationally. For national phase filings, you may request translation into your local language (additional translation fees may apply).

4. Do you provide an NDA (Non-Disclosure Agreement)?

Yes. An NDA is signed online before you submit any confidential details about your invention.

5. Do I need a separate order for each invention?

Not necessarily. You can submit a single order, specify your target country or countries, and our admin team will review your request and inform you about the best roadmap.

6. Can I file in multiple countries at the same time?

Yes. You can provide us with a list of your desired countries, and we will review the possibilities and manage the process accordingly.

7. What is the difference if I already have an international (PCT) filing?

In that case, you are entering the national phase through the PCT system. This path is usually smoother, since WIPO has already conducted preliminary reviews and prior art searches.

8. Are national patent laws very different across countries?

Not significantly. Most countries follow a similar international framework. However, there can be slight differences in procedures or preferences, which our experts will handle for you in each jurisdiction.
